Article 1 Establishment Travel Contract

  1. The travel agreement takes effect as soon as the traveler accepts Travel Papua’s offer.
  2. Once the booking is confirmed it only can be cancelled according to the cancellation policy as stated in Article 8 of this travel agreement.
  3. If the traveller is a minor, a parent or guardian of the minor need written authorization.
  4. A travelers who makes an agreement for multiple people is responsible for all obligations. Each person covered by the agreement is responsible for their own part. The traveler must provide personal information for themselves and the people they’re traveling with. Details that need to be provided are passport details,  age, disabilities, chronic illnesses, and dietary needs. This information must be sent directly to Travel Papua after confirming the agreement. A mobile phone number and email address should also be provided, along with emergency contact details for the travelers at home.
  5. The traveler must inform Travel Papua about any important details regarding their group that could affect the tour. If the traveler fails to provide this information and it leads to the exclusion of the traveler(s) from the trip, as mentioned in Article 11, paragraph 2, the costs will be charged to the traveler.
  6. If travelers request specific services from Travel Papua, such as a particular airplane seat or hotel room location, Travel Papua will try to accommodate these preferences whenever possible. However, these requests are not legally binding, even if they are mentioned in the travel documents.

 

Article 2 The travel range of Travel Papua

  1. The travel range of Travel Papua is stated on the website www.travelpapua.com. Obvious errors or mistakes on this website are not binding for Travel Papua. Such errors should be easily recognizable to the average traveler at first glance.
  2. Travel Papua is not responsible for any general information, photos, brochures, advertisements, websites, or other media created or issued by third parties.
  3. The offer from Travel Papua is not binding and can be revoked if necessary. If there are mistakes in the pricing or other errors, they can cancel the offer. This cancellation must happen as soon as possible, but no later than 24 hours after the offer is accepted, with a justification provided. In such cases, the traveler is entitled to a full refund of any payments made. However, once an offer is accepted by the traveler and all terms are agreed upon, cancellation can only occur according to the cancellation policy.

 

Article 3 Payments

  1. At the end of the travel agreement, the traveler is required to pay the fare. Payment is made by transferring the amount to Travel Papua’s bank account, as specified in the invoice sent with the booking confirmation. The payer is responsible for any bank charges associated with the payment.
  2. The deposit for the booking is 25% of the total amount, with a minimum of €250. Flights are excluded from this deposit and must be paid in full before they can be issued.
  3. The deposit must be made within 10 days of receiving the invoice to the account of Travel Papua. The remaining payment has to be received 45 days before the tour starts, on the account of Travel Papua. If the traveller departs within six weeks, the entire bill has to be paid after receiving the invoice.
  4. If the payment is not made on time, the traveler is considered to be in default. After receiving an email reminder, they have 7 working days to complete the transfer. If the payment is still not made after 7 days, the contract will be canceled as of that day. In this case, the cancellation terms in Article 8 will apply, and any refund will be subject to cancellation fees.
 

Article 4 The fare

  1. As published on our website www.travelpapua.com the prices are per person and include only the services and facilities as defined on the arrangements of Travel Papua.
  2. The published travel is based on prices, exchange rates, levies and taxes as of Travel Papua known during publication.
  3. Travel Papua reserves the right, to increase the costs of the travel agreement until 14 days before the day of departure, due changes in transportation, fuel costs, charges and exchange rates.
 

Article 5 Duration and programs

  1. The Travel Papua website specifies the duration of trips in whole days, including the day of departure and the day of arrival. The times listed on the website are not final; the confirmed departure and arrival times will be provided in the travel documents.
  2. Incidental or structural changes to the timetables and schedules of public transport, including local airlines, may affect travel times. Travelers cannot claim a refund from Travel Papua for any part of their holiday due to these changes. Additionally, Travel Papua is not liable for any damages or losses caused by delays. If travel times are extended, the traveler must cover any additional costs, such as staying an extra night in a hotel or transport services, which are not included in the original travel agreement.
 

Article 6 Travel Documents and Luggage

  1. The traveler is responsible for having all necessary documents, including a valid passport, required visas, proof of immunizations and vaccinations, and possibly an international driving license. Additionally, the traveler must check with the relevant authorities to ensure that departure and arrival information has not changed before leaving.
  2. This includes being aware of any pandemic or epidemic issues that may require additional health checks or medical reports to enter the country.
  3. The traveler must also have valid travel and accident insurance during the trip and should carry proof of this insurance at all times.
  4. The confirmation received from Travel Papua provides an overview of the itinerary and, along with the invoice, serves as proof of booking. Both documents should be kept safe.
  5. Not later than 7 days before departure, the traveller receives his / her travel documents.
  6. If the travel documents are not on time, the traveller will have to contact Travel Papua
  1. If the traveler is unable to participate in the trip due to not having any required (valid) documents, they will be responsible for the consequences. Travel Papua is not liable for this.
  2. Travel Papua is not liable for any loss, damage, or theft of luggage, as well as for issues related to legitimacy requirements, such as valid passports, required visas, travel permits, and other travel documents. Travelers are responsible for ensuring they have all necessary documentation and for safeguarding their belongings during the trip.

 

Article 7 Amendment by the traveler

  1. If Travel Papua has sent the booking confirmation and invoice, and the traveler requests a change to the itinerary afterward, a change fee of €25 will apply, along with any additional travel costs. Generally, changes are not allowed within 28 days of departure.
  2. Attention! To change a flight ticket, the conditions of the airline will apply.
 

Article 8 Cancellation by the traveller

If a contract is canceled, the following cancellation fee will be charged to each traveler. The traveler must submit the cancellation of the travel agreement via email, and the date the email is sent will be considered the cancellation date. Note: Once flight tickets are issued, there will be no refund.

Each traveler will be responsible for the following cancellation fees, which can be refunded by the head booker:

  • Cancellation up to 2 months before the start of the trip: 25% of the total payment.
  • Cancellation from 2 months to 30 days before the start of the trip: 50% of the total payment.
  • Cancellation from 30 days to 14 days before the start of the trip: 75% of the total payment.
  • Cancellation from 14 days to the day of the trip: 100% of the total payment.
 

Note: Bank costs related to the refund will be the responsibility of the traveler.

 

Article 9 Amendments and Cancellations of the Travel Agreement by Travel Papua

  1. Travelers who seek adventure also accept certain risks. Local conditions at the destination and the adventurous nature of Travel Papua’s trips may require adjustments while traveling. Changes due to bad weather are included in this. Adjustments could involve departing from a different airport or using another vehicle and driver (if possible with the same type, etc.). In exceptional cases, these changes may lead to differences in the itinerary, excursions, accommodations, and local transport compared to the original booking. If Travel Papua needs to make alternative arrangements, the traveler can be assured that the quality and intent of the trip will be maintained as much as possible. Travel Papua will strive to minimize any negative impacts. In these situations, Travel Papua and the traveler can make new arrangements based on the changes, which will be considered part of the original travel contract
  2. Travel Papua has the right to change the travel agreement for important reasons that affect a specific part of the trip. In such cases, the traveler is entitled to either an alternative trip of at least equal value or a refund of the advance payment (or a proportionate amount if part of the trip has already been completed). If any modifications are necessary, it will be discussed with the traveler to ensure both parties can agree on the changes. If the alternative trip costs more, the traveler must pay the difference; otherwise, they may choose to cancel and request a refund. If the traveler wishes to request a refund for any unused portion of the trip that Travel Papua cannot organize due to these important reasons, they must contact Travel Papua within 24 hours of the amendment to inform them.
  3. Travel Papua has to notify all changes in the travel agreement and the circumstances that cause the changes, immediately to the traveller.
  4. If changes occur after the trip has started, Travel Papua will arrange suitable alternatives to continue the journey. If it’s not possible to provide these alternatives, or if the traveler has reasonable grounds to refuse the alternative, Travel Papua will ensure the traveler is returned to the original departure point or to another agreed-upon location.
  5. In the event of force majeure—such as terrorism, bombings, war, political unrest, natural disasters, extreme weather, strikes, or failures by airlines—Travel Papua has the right to cancel or change the travel agreement before the trip starts and even during the trip. Travelers will be informed immediately about these situations. Under these circumstances, travelers cannot make claims against Travel Papua for any changes or cancellations due to force majeure events. Travelers are encouraged to contact their travel insurance provider to understand their coverage and options in these situations.
  6. If the Department of Foreign Affairs issues a travel warning, Travel Papua will heed this advice, as outlined in paragraph 5 of this article.
 

Article Liability of Travel Papua

  1. Travel Papua is responsible for fulfilling the obligations outlined in the travel agreement. This means that travelers should have reasonable expectations based on the information provided on Travel Papua’s website, considering common knowledge about specific destinations. The execution of the travel agreement will also take into account local customs, culture, infrastructure, and any restrictions or habits that may be part of the adventurous nature of Travel Papua’s trips.
  2. Travel Papua is not liable for damages resulting from: a. Issues related to the travel agreement that are the traveler’s responsibility, including their health condition. b. Actions or factors that are not directly related to the services provided by Travel Papua or are caused by third parties. c. Loss or theft of personal belongings during the trip, including in vehicles or accommodations rented by Travel Papua. d. Situations that are beyond Travel Papua’s control, including those not reasonably attributable to them under the law or accepted standards.
 

Article 11: Obligations of Passengers

  1. The traveler must carefully read the instructions from Travel Papua and the local guides, and follow them to ensure the trip runs smoothly. The traveler is responsible for any damage caused by failing to meet this obligation.
  2. If a traveler causes disruption or trouble that makes the trip difficult to conduct, Travel Papua or the guide may exclude them from further participation. If the traveler is responsible for any embarrassment or inconvenience, they will be liable for any resulting costs. In this case, there will be no refund for any activities or experiences that were missed or affected.
  3. If a traveler is not satisfied with the trip, they should contact Travel Papua directly within 24 hours of the complaint to be eligible for an alternative trip, as mentioned in point 9 of this article. Complaints made after this time can be difficult to address, as many issues can often be resolved on the spot rather than afterward.
